Lawyer Karen Hernández and law that allows change of surnames: "It can only be done once in life"

In the citizen ADN we talked with lawyer Karen Hernández, about the law that allows the change of order in the surnames.

"What establishes Law 21,334 is that in principle a child's parents should agree to decide what surname should go first," explained the leading lawyer of the collaborative legal project, belonging to the Faculty of Law of the Law of the Law of the Law of theSan Sebastián University.

In line with the above, the expert added that "the same law contemplates that in the absence of agreements, the general rule will always predominate, which in this case is the paternal surname."

“This law regulates, among other situations, the case in which there was no determined affiliation by both.It could be that a child has only a father or mother.In that case, evidently the last name that predominates will always be that of that person who registered him in the Civil Registry service, ”he said.

The change of surnames: a very important decision

Something to consider by people who wish to change their last name is that it can only be done once in life.

“The law is clear and indicates about the name change and also the alteration of the surnames, it can only be done once in life.That is why it is so recommended that people think this decision very well, ”said Hernández.

Then, the lawyer added that "this decision not only affects the purpose of rectifying the birth certificate, but also with respect to the identity card, the driving license and the passport."

“It is a decision that must be very thought by the citizen because the law does not contemplate rectification or repentance comes.If a person alters his surname order, he will not be able to return to the situation in which he was in advance, ”he said.

On the other hand, the expert mentioned that the law only contemplates the change in the order of the surnames."This idea does not consecrate to incorporate a different surname, notwithstanding that there are many families that did it historically."
