Safeguard a Spanish surname in danger of disappearance.STS analysis 629/2021 · Legal news

Contrary to what it comes in the Anglo -Saxon world, where the change in surnames enjoys some ease, in our legal system, this possibility is very diminished by the requirements that the current legislation establishes, since the determination of the surnames not onlysets the faithful right to identity, but also the subject's affiliation, which is an issue that must compete and worry about public authorities.

In that area, the recent judgment of the Supreme Court 6two9/two0two1 of September two7, whose lawyer I have held as my own matter (saving my maternal last name), has meant a before and after when determining the possibility (and requirements) In a matter of draft: save a Spanish surname in danger of extinction, something that was expressly collected in the law of June 8, 1957 of the Civil Registry (hereinafter LRC57, today repealed), and that continues to be collected in the regulations of the regulationsCivil Registry of November 14, 1958 (hereinafter RRC, still in force).

The starting point is a last name in evident danger of disappearance, in this case it was "vacuar", second surname of who subscribes, which, according to certification of the INE of February two7, two017, at that time there were 9 individuals with "Copulate "as the first surname, and 11 as second surname (among which I include my46.449.565 Spaniards to the same date (according to INE data), made the alleged danger very noticeable.And just two50 with spelling "B".

The first thing that came to mind to be able to save my maternal last name, was to make use of the provisions of article 198 of the RRC, that is, directly invest the order of my surnames, so that my newborn daughter at the time ofThe application obtained, by means of article two17 RRC, the surname "Vacel".However, this idea did not seduce me.Given my age then, 37 years, I was relevant, both bureaucratic, as well as in legal traffic and lawyer (which expressly recognizes the sentence), so I discarded it immediately, and tried to explore another way that there was nobeen previously tried: to promote, together with the mother, a change of surnames in the child so that my two surnames could be joined in one, and that she went on to possess "Rodríguez-Vacelar" as the first last name, plus the maternal, union that I could not do, since as we are going to see below, it is not possible to join last names of different branches (paternal with maternal), but that in my daughter it was possible.

For this I took the art as it.57 of the LRC57 that indicated as requirements to proceed with a change of surnames:

"1.º That the last name in the proposed manner constitutes a situation of fact not created by the interested party.

two.º That the last name or surnames that are tried to unite or modify legitimately belong to the petitioner.

3.º That comes from the line corresponding to the last name that is to alter."

Subsequently, I took article 58 of the already extinct LRC57, vault key to achieve the intended change:

“It will not be necessary to attend the first requirement of the previous article to change or modify a surname contrary to the decorum or that cause serious inconveniences, or to avoid the disappearance of a Spanish surname."

En cuanto al RRC, los artículos two05 y two08 recogen los mismos extremos citados, debiéndose tener en consideración, además, el artículo two06, que indica:

The changes can consist of segregation of words, aggregation, transposition or suppression of letters or accents, suppression of articles or particles, translation or graphic or phonetic adaptation to Spanish languages, and in substitution, award or aggregation of other names or surnames or partsurnames or other analogues, within legal limits.

Unions will not be able to exceed two words, without counting articles or particles.

Once the legal framework in which I could move, I saw it very obvious that I met the legal requirements required, which I accredited with huge documentary evidence.

En cuanto al primer requisito, entendí que no era exigible en virtud de los artículos 58 LRC57 y two08 RRC, toda vez que el riesgo de desaparición del apellido era muy evidente, quedando por probar, en todo caso, que se trataba de un apellido español. En cuanto al segundo requisito, se cumplía enteramente puesto que pretendía unir dos apellidos: “RODRÍGUEZ" y “VACELAR" que como quedó acreditado en los certificados de nacimiento aportados, pertenecían legítimamente a la peticionaria que actuaba mediante sus representantes legales, al ser el primer y segundo apellido de su padre. Tomando el orden común de apellidos, serían el 1º y 3º apellido de la menor (RODRÍGUEZ + “primer apellido de la madre" + VACELAR + “segundo apellido de la madre ").

En cuanto al tercer requisito, se cumplía igualmente de manera completa, ya que los apellidos que resultaban después del cambio NO provenían de la misma línea. Después del cambio, el nombre y apellidos completo de la menor sería “nombre de pila de la menor" + RODRÍGUEZ-VACELAR + “primer apellido de la madre", de manera que el primer apellido (“RODRÍGUEZ-VACELAR") y el segundo provenían de líneas diferentes totalmente diferenciadas: en el primer caso, de la línea paterna, al ser la unión de los dos apellidos del padre; y en el segundo caso, de la línea materna, al ser el primer apellido de la madre.Therefore, the requirement that forces both totally differentiated affiliations was met.

As can be seen in the sentence (whose reading we recommend), the DGRN, and later in the judicial route in the first and second instance (today regulated by the ART.781 bis Lec), dismissed all the requests made on the basis that:

En cuanto a la posibilidad de invertirme los apellidos, y evitar con ello un “fraude de Ley", establece que “no consideramos concurra fraude de ley, sino una opción legal, que se encuentra en este caso debidamente justificada. En efecto, la agregación de apellidos es un mecanismo normativo expresamente previsto para la conservación de aquellos que se encuentran en peligro evidente de desaparición".

Con respecto a que el apellido resultante no sea exactamente idéntico al que se pretende salvar, indica: “no podemos compartir el argumento de que constituye un obstáculo legal insuperable, la circunstancia de que no es lo mismo un apellido simple (Vacelar) que el constituido por la unión o anexión a otro nombre familiar (Rodríguez-Vacelar); puesto que la agregación de apellidos se encuentra expresamente contemplada como instrumento legítimo de tal cambio".

Y finalmente, en relación con que el segundo apellido paterno no pertenezca legítimamente a la menor por no ser uno de los dos apellidos que la misma ostenta registralmente, se corrige a la Audiencia Provincial al manifestar: “dicho argumento no puede ser compartido, puesto que Vacelar es un apellido que, desde hace más de 300 años, pertenece a la familia de la niña y que constituye el segundo de los apellidos de su progenitor, como así figura en la partida de nacimiento de la menor".

Esta Sentencia es especialmente relevante una vez que el pasado 30 de abril de two0two1, después de diez años, la LRC57 fue derogada, entrando en vigor la Ley del Registro Civil de two011, la cual no contiene expresamente una disposición para salvar un apellido español, pero que, gracias a la Sentencia objeto de este artículo, futuros peticionarios podrán apoyarse en la misma para indicar que el salvar un apellido español es “causa justa y legitima", además de poder seguir alegando el RRC que sigue en vigor a esta fecha, y que sigue recogiendo dicha posibilidad en su artículo two08.

También es relevante porque despeja toda duda sobre que, más allá de que todos tengamos únicamente dos apellidos en nuestro DNI, por ser los inscribibles, todos los apellidos de nuestros antepasados siguen siendo legítimamente nuestros, y que unir apellidos es una formula perfectamente válida para salvar un apellido español, lo que, por cierto, es importante reseñar que en otros casos, quizás de personajes más “relevantes", la DGRN ha fallado a favor sin que se tuviera que judicializar el asunto.
