Homeclothes → Yeah, the DGT can fi...

Yeah, the DGT can fine us for driving with a coat, gloves or mountain boots, and these are the reasons.

Winter has not come properly, but it is the low temperatures. And with them, the need to wear the coat, of course. But driving with this garment on, especially if it's too thick, is not recommended and we can even be fined for it.

Among the DGT's usual advice is to wear suitable and comfortable clothing at the wheel, both in clothing and in footwear.

However, although the regulations do not expressly prohibit it, failure to comply with this recommendation, such as wearing the coat on the wheel as well as flip-flops in summer, may violate some of the provisions contained in the General Circulation Regulations.

That is why it may be liable to punishment if a traffic agent considers it to be so in the event that we are involved in a mishap or accident.

Coat and gloves, better without them

A coat, raincoat, jacket or the like usually reduces mobility in the arms, so it can prevent us from driving the steering wheel comfortably and from reacting worse to an unexpected one. Even more so if the coat garment is bulky, although it always depends on the driver's ability.

Thus, not taking off your coat while driving can enter into the interpretations referring to several precepts of the regulation of circulation contained in Royal Decree 1428 / 2003. And that's what an agent can turn to if he interprets it.

For example, Article 18.1 of Chapter 1, which sets out the general rules of movement, stipulates that:

And precisely a thick coat garment could fail to do so as it diminishes the freedom of movement. But in addition, this same article states that:

Sí, la DGT nos puede multar por conducir con abrigo, guantes o botas de montaña y estos son los motivos

Again, wearing this garment during driving could contradict this requirement, because it is bulky, it could prevent us from taking the right position on the seat, which includes wearing the seatbelt fastened.

But in addition, Article 17.1 of this regulation also states that drivers must at all times be in a position to control their vehicles. "so it could also be inferred that this is not the case if with this garment we cannot properly govern the steering wheel.

Finally, Article 3.1 specifies that:

Another precept that could well be applied if you move in a coat garment that prevents us from driving the controls of the car properly. The same rules may also apply to gloves, which depending on their textile material can slip on the steering wheel or gear lever.

Well, it's true that in winter, and even more so if you park on the street, the car compartment can be a whole fridge. This is solved when we turn on the heating, but until the engine gets a certain temperature, it doesn't start heating the inside.

Although this has been minimized in the most modern cars, if the car is older, it will take longer to do so. In any case, it is best to start the engine and wait with the car standing until hot air starts coming out of the air conditioning nozzles. Thus, we can take off our coat once the heating starts to be noticed and thus start to go.

In addition to diminishing the movements, once the car has already heated up, if we wear the coat we can begin to suffer excessive heat. This may affect concentration, which in turn violates article 18.1 (permanent care). And needless to say, you have to take off this moving garment, it can be dangerous.

La temperatura recomendada para el interior del habitáculo del coche durante la conducción, ya sea invierno o verano, es de entre 23º y 24ºC.

Finally, a coat if it is too bulky can interfere with the proper functioning of the seat belt and fail to hold us properly in the event of an accident.

The same applies to other occupants, for example children, as the DGT recalls: if they sit on the child's seat with their coat on, the way they fit into it changes, increasing the chances that they will get fired in a crash or a sudden brake. Según una encuesta realizada por la fundación CEA, en la zona norte de España, uno de cada cinco automovilistas asegura conducir con el abrigo puesto durante el invierno. Y en el caso de Madrid, un 15 % afirma hacerlo.

Shoes also matter and mountain boots are not a good idea

The three aforementioned articles of the Circulation Regulation may also apply to inappropriate footwear. Because if a given agent understands that he can't handle the pedals properly, he can punish us anyway.

And this group includes, for example, mountain boots, or any footwear that involves too thick a sole (for example if they have a platform) and which prevents the proper touch with the pedals.

According to the real Automobile Club of Spain (race), and which collects the DGT, an appropriate shoe to drive is the one that:

Above all, it would be the latter who would break mountain boots or shoes with a platform. So the most recommended thing is that if where we go we need shoes that are not suitable for driving, we carry in the trunk one that is, and we change when we go around.

Fines of 80 euros

All penalties that may be applied for driving with inappropriate shoes or clothing correspond to minor offences and always depend on the agent's interpretation.

Not in vain, in these cases the codified sanctions always add "the facts must be concrete". In other words, we may be fined if we are involved in an incident and the agent determines that it is a direct cause of the mishap, and may consider negligence on the part of the driver.

Driving without ensuring proper freedom of movement or maintaining an incorrect position is punishable by 80 euros, which can stay at 40 euros if we stick to the prompt payment.
